By-laws on the use of motorhome pitches in the town of Borgholzhausen dated 07.05.2026
The Borgholzhausen Town Council, pursuant to Sections 7 and 41(1)(f) of the Local Government Act (GO NRW) for the State of North Rhine-Westphalia, as set out in the notice published on 14 July 1994 (GV. NRW. p. 666), as last amended by Article 1 of the Act of 10 July 2025 (GV. NRW. p. 618), in conjunction with Section 6 of the Local Taxes Act of North Rhine-Westphalia (KAG NRW) of 21 October 1969 (GV. NRW. p. 712), as last amended by Article 5 of the Act of 12 May 2015 (GV. NRW. p. 448), adopted the following Statutes at its meeting on 07.05.2026:
§ 1 General Provisions; Scope of Application
The town of Borgholzhausen operates motorhome parking spaces as municipal public facilities in accordance with Section 8(1) of the Local Government Act of North Rhine-Westphalia (GO NRW).
These Statutes apply to the areas designated as motorhome parking spaces by means of information boards, layout and signage at the following locations:
1. Ravensberger Straße 35, 33829 Borgholzhausen
2. Bergstraße 19, 33829 Borgholzhausen
The areas of application are shown on the site plan attached as an annex.
§ 2 Permitted Use
(1) The area is designated for the temporary parking of motorhomes and for the temporary accommodation of the persons travelling in them.
(2) The parking of caravans without a towing vehicle, residential trailers, motor vehicles, motorbikes, coaches, mobile sales vehicles and trailers, as well as tents, is not permitted. The permanent parking of motorhomes is not permitted. Vehicles parked without authorisation will be removed at the owner’s expense. Camping (awnings, etc.) is not permitted.
(3) Motorhomes may only be parked if they are equipped with suitable facilities for retaining waste, waste water and sewage on board.
§ 3 Permits, Registration and Fees
(1) The designated parking spaces are available for motorhomes for a maximum of 5 days.
(2) An overnight fee is payable for the use of a parking space. The fee is 15.00 euros per vehicle. The fee is due at the latest when the motorhome remains on the parking space overnight. An overnight stay is defined as any stay between 7.00 pm and 9.00 am. Use of the site is not permitted without an overnight stay; day visitors may use the adjacent car parks. The usage fee must be paid exclusively via the online payment system designated by the city.
(3) It is not possible to reserve a pitch. Reserving pitches is not permitted.
(4) Arrival and departure should take place without causing noise disturbance.
§ 4 Facilities and Use of Utility and Waste Disposal Facilities
(1) The site on Ravensberger Straße has 6 marked motorhome pitches and a total of 2 electricity points with 6 sockets. The site on Bergstraße has 3 motorhome pitches and a total of 1 electricity point with 3 sockets. Use of the electricity supply system is subject to payment of the overnight fee. Capacity is limited; there is no entitlement to availability. There is no entitlement to permanent and unrestricted functionality.
(2) A Holiday-Clean station is available on Ravensberger Straße for the disposal of waste water. There is also a floor drain for grey water at this location.
(3) A fresh water supply point is located on Ravensberger Straße. Use of fresh water is included in the overnight stay fee. Capacity is limited; there is no guarantee of availability. There is no guarantee of continuous and unrestricted functionality.
(4) Normal household quantities of waste may be disposed of in the bins provided.
(5) The disposal of waste water outside the designated station is not permitted.
§ 5 Tidiness and Cleanliness
(1) All visitors must keep their pitch clean. Noise disturbances such as slamming doors, loud music or loud conversations must be avoided. The statutory night-time quiet hours apply in accordance with § 9(1) of the Act on Protection against Air Pollution, Noise and Similar Environmental Impacts (State Immission Control Act – LImschG NRW) between 22:00 and 06:00.
(2) The pitch must be left in a clean condition after use. Small amounts of rubbish may be disposed of in the bins; larger quantities must be taken away.
(3) All users are obliged to maintain order and cleanliness. All facilities and equipment must be treated with care.
(4) No winter maintenance is carried out on the motorhome pitches.
(5) Group trips or the joint parking of several motorhomes may be prohibited or restricted if this impairs the functionality of the site, safety or consideration for other users.
§ 6 Animals
(1) Pets are permitted on the pitch. They must be kept in such a way that no one is inconvenienced more than slightly by any disturbances caused by them, in particular by the noise they make. Dogs must be kept on a lead at all times.
(2) No additional fees are charged for animals.
(3) All animal waste must be cleared away immediately.
§ 7 Prohibitions
The following, in particular, are not permitted:
1. the washing and repair of vehicles, except for repairs carried out to restore roadworthiness,
2. the parking of motorhomes as part of or in connection with a commercial enterprise or for commercial purposes. This also applies to mobile sales stalls, promotional vehicles or commercial overnight stays,
3. parking caravans, trailer tents, motor vehicles, motorbikes, coaches and sales trailers on the motorhome pitches,
4. camping,
5. open fires and the lighting of campfires; barbecuing using gas or electric barbecues is permitted,
6. reserving pitches (bookings),
7. discharging waste water and sewage outside the designated disposal point,
8. the use of generators,
9. the disposal of household waste or the littering of the site and its surroundings,
10. storing freestanding gas cylinders next to the motorhome,
11. using public car parks as motorhome parking spaces between 19:00 and 09:00 outside the designated pitches within a radius of 200 m.
§ 8 Liability
(1) Use of the motorhome site is at the user’s own risk. The town of Borgholzhausen accepts no liability for damage caused by a failure of the electricity or drinking water supply systems or the waste disposal facilities. Liability for damage caused by force majeure is excluded. Liability arising from wilful misconduct or gross negligence remains unaffected.
(2) The user is liable for any damage caused by them to the site facilities.
(3) The pitches may be closed at short notice for specific reasons, in particular during events. There is no entitlement to use the site during such periods.
§ 9 Powers of control
The town of Borgholzhausen and its authorised representatives exercise powers of control. Instructions must be complied with immediately. Illegally parked vehicles and trailers may be removed at the owner’s expense.
§ 10 Orders in Individual Cases, Coercive Measures
(1) The town may issue orders in individual cases to ensure compliance with the obligations set out in these By-laws.
(2) The provisions of the Administrative Enforcement Act of North Rhine-Westphalia shall apply to the enforcement of the acts of tolerance or omission prescribed in these By-laws.
§ 11 Administrative Offences
(1) A person commits an administrative offence if, intentionally or through negligence, they
1. use the motorhome pitches contrary to the permitted use set out in § 2;
2. use the motorhome pitches without the necessary permission or registration in accordance with § 3 of these By-laws;
3. disposes of waste outside the designated waste bins or disposes of more than a normal household quantity in accordance with § 4(4) of these By-laws;
4. disposes of waste water outside the disposal points, contrary to § 4(5);
5. fails to comply with the rules governing the motorhome pitches as set out in § 5 of these By-laws;
6. keeps animals other than pets or fails to keep dogs on a lead in accordance with Section 6 of these By-laws;
7. breaches the general prohibitions set out in Section 7 of these By-laws.
(2) Breaches of the provisions of these By-laws may be punished with a fine of up to €1,000 in accordance with Section 17(1) of the Act on Administrative Offences (OWiG). The competent authority within the meaning of Section 36(1)(1) of the Act on Administrative Offences (OWiG) is the mayor.
§ 12 Entry into force
These By-laws shall enter into force on the day following their publication. (01.09.2026)
